====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 307, 326 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Different persons caused fire arm injury to Murari Yadav including the petitioner. Though F.I.R. contains general and omnibus allegation of firing and causing injury, however, statement of Murari Yadav before the police reveals that petitioner had caused injury with firm arm behind the back of the head of Murari Yadav. Doctor has found fire arm injury on the occipital region. Petitioner is in custody since 08.05.2019. learned counsel for the informant opposed the prayer for bail.

Patna High Court CR. MISC. No.49436 of 2019(3) dt.21-01-2020 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Gogari P.S. Case No. 308 of 2018 pending in the Court of learned C.J.M., Khagaria. Prayer for bail of the petitioner is refused. Petitioner may renew prayer for bail after framing of the charge.
