JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and the Additional Public Prosecutor.

The petitioner apprehends his arrest in a case under Sections 302, 328/34 of the Indian Penal Code. The petitioner is husband of Nayan Tara Devi (deceased). The informant is the mother of the deceased. As per prosecution case the petitioner tortured the informant's daughter and subsequently administered poison. The petitioner submits that earlier an UD case, bearing case no. 0 of 2015, was registered on 16.04.2015 thereafter the instant case has been filed with malicious intention. It appears from the order of the learned court below that the victim died on account of poison, in this view of the matter, I am not inclined to grant anticipatory bail to the petitioner.
