The petitioner is languishing in custody for the offences punishable under Sections 25(1-b)a/26 of the Arms Act.

From the house of the petitioner a country-made pistol and cartridge was recovered. The petitioner is in custody since 29.03.2019. The petitioner has got no criminal antecedent. No other family member of the petitioner is accused in this case.

Further submission is that the recovery was not made from the conscious possession of the petitioner. Considering the aforesaid fact, let the petitioner,

No.46431 of 2019(2) dt.29-07-2019 2/2 above named, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ghosi (Okari O.P.) P.S. Case No.124 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
