2. The petitioner has preferred this application for grant of regular bail in connection with Gopalpur P.S. Case No. 114 of 2020 dated 04.04.2024 registered for the offences punishable under Sections 302 read with Section 34 of the I.P.C. and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have shot the informant's husband due to which he died.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

There is no specific allegation against the petitioner whereas the specific allegation of firing on the informant's husband is against the co-accused, Purushottam Yadav @ Chhotu Yadav. It is further submitted that as per the postmortem report, it is apparent that three gunshot injuries have been found on the deceased. The petitioner has no concern with the alleged occurrence. The co-accused person has already been granted regular bail by this court vide order dated 15.04.2025 passed in Cr. Misc. No.9404/2025. The petitioner has 10 criminal antecedents in which he is on bail in seven cases and he is acquitted in three cases as stated in para 3 of the bail petition. The petitioner is in custody since 23.04.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the anticipatory bail application of the petitioner was earlier rejected by the Coordinate Bench of this court vide order dated 15.11.2022 passed in Cr. Misc. No. 28448/2022.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

No.49657 of 2025(2) dt.15-10-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Session Trial No. 376/2024 arising out of Gopalpur P.S. Case No. 114 of 2020, with the following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
