Petitioner apprehends arrest in Siwan Muffasil P.S. Case No.66 of 2012 instituted for the offences under sections 147, 149 and 302 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that there is no specific allegation against this petitioner of causing fire arm injury to the son of the informant. He has further submitted that in para 23 of the case diary it has come that licensee gun of the informant was seized and during F.S.L. examination, as mentioned in para 67 of the case dairy, pellet, which has caused injury to the son of the informant, was fired from that gun. It has been further submitted that the doctor in the post mortem report has stated that it may be a case of suicide because such type of injury can only be caused in suicide. It has been submitted that the case of this petitioner stands on similar footing to the co-accused who have already been allowed
Patna High Court Cr.Misc. No.50445 of 2017 (2) dt.30-10-2017 2/2 bail by one of the coordinate Bench of this Court on 06.10.2017 in Criminal Misc. No. 33560 of 2017. The learned APP does not dispute this fact.
Considering the fact that the case of this petitioner stands on similar footing to the case of co-accused who has been allowed bail by one of the coordinate Bench of this Court in Criminal Misc. No.33560 of 2017, the prayer for grant of anticipatory bail is allowed and in the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Siwan Muffasil P.S. Case No.66 of 2012, he shall be released on anticipatory bail on furnishing bail bond of 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
