JUSTICE PURNENDU SINGH ORAL ORDER 18-07-2024 Petitioner has inter alia prayed for following reliefs in the paragraphs No.1 of the writ petition:- "That the present application is for issuance of a writ in the nature of Mandamus directing the respondents to give to the petitioner the benefit of 3rd A.C.P. as has been given to all including his juniors with effect from 01/01/2009 and also for a direction to pay to the petitioner @ 9.5 % on all the arrears of all retiral dues on account of commutation, leave encashment and balance of Gratuity amount and also upon the 10% Pension amount which was illegally deducted from 01/08/11 and for any other direction in the facts and circumstances."

2. Considering the fact that the case of the petitioner for grant of 3rd A.C.P. was considered by the Screening Committee for granting financial up-gradation to those

Patna High Court CWJC No.11099 of 2013(4) dt.18-07-2024 2/2 employees, who had not been given regular promotion in accordance with the scheme of A.C.P. and the same was rejected in view of the fact that the petitioner had already retired on 31.07.2009, I don't find any merit in the present writ petition and, accordingly, the same is dismissed.
