Ranjit Yadav had assaulted with hockey stick while Umesh Yadav assaulted with Farsa to Baidhyanath Yadav. On hue and cry, Mahesh Yadav, Umesh Yadav, Bablu Yadav, Arun Yadav, Dinesh Yadav came on rescue, out of whom, Mahesh Yadav was assaulted by Umesh Yadav with Farsa, Ganeshi Yadav by iron rod, Gayanand Yadav (petitioner), Fuchchi Yadav, Mukesh Yadav, Nitish Yadav and other assaulted Dinesh and Umesh with iron rod. Ranjit Yadav snatched away mobile of Mahesh Yadav.

From the order impugned, it is apparent that during course of treatment, Mahesh Yadav died. It is also apparent from Annexure-3 series that Umesh Yadav and Dinesh have sustained

Patna High Court Cr.Misc. No.17459 of 2015 (02) dt.11-05-2015 simple injury caused by hard and blunt substance. Petitioner is the non-assailant of deceased.

Accordingly, petitioner, Gayanand Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Rosera, Samastipur in connection with Singhiya P. S. Case no.181 of 2014.
