Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.
This matter has been taken up for out of turn hearing as one of the petitioners i.e. petitioner No.2 is reported seriously ill in the jail.
Allegation is of recovery of liquor from the outer
Patna High Court CR. MISC. No.58243 of 2021(2) dt.28-10-2021 2/3 house of the petitioners who are father and sons. Petitioners have got no criminal antecedent.
Submission is that the place of recovery is accessible by anyone. Petitioner Nos.1 and 3 are in custody since 25.07.2021 and petitioner No.2 is in custody since 27.07.2021 respectively.
Considering the completion of investigation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kargahar (Barhari O.P.) P.S. Case No.104 of 2021 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (c) The petitioners shall not leave the country without permission of the trial Court.
If the petitioners would be found having criminal antecedent of identical nature, that would be a ground for
Patna High Court CR. MISC. No.58243 of 2021(2) dt.28-10-2021 3/3 cancellation of bail.
