This is a petition for grant of regular bail in a case under Sections 302 and 201/34 of the Indian Penal Code. There is direct allegation of assault by the petitioner (Bhainsur) of the informant by lathi and danda. However, post-mortem report suggests that the husband of the informant collapsed probably due to blunt injury on head and the body thrown to water after death. Hence, having regard to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner in connection with S.Tr. No. 31 of 2015 arising out of Koilwar P.S. Case No. 101 of 2014 pending in the Court of learned 1st Additional Sessions Judge, Ara. Accordingly, prayer for bail is rejected.
