2. The petitioner seeks bail in Darpa P.S. Case No. 79 of 2023 registered for the offence punishable under Sections363, 366(A) of the Indian Penal Code and Section-8 of the POCSO Act.
3. It is alleged that the informant's minor daughter left her house to attend call of nature but she did not return.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that from perusal of the record, it appears that in course of the age determination, the
Patna High Court CR. MISC. No.51914 of 2024(2) dt.30-07-2024 2/2 doctor has found the victim aged about 17-18 years. The victim in her statement recorded under Section 164 of the Cr. P.C. has not supported the case and has stated that she was in love with the petitioner for two years. The petitioner is in custody since 08-06-2024.
5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-Special Judge, POCSO/Concerned Court, East Champaran, Motihari in connection with Darpa P.S. Case No. 79 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
