Earlier prayer for anticipatory bail of the petitioner was rejected by this court vide order dated 13-04-2017 passed in Cr. Misc. No. 6749 of 2017.

It has been submitted that after rejection of the bail petition of the petitioner, some of the co-accused have been granted anticipatory bail by this court vide orders dated 13-072017 and 23-08-2017 passed in Cr. Misc. No. 30172 of 2017 and 38634 of 2017 respectively.

Counsel for the petitioner has submitted that there was free fight between the parities on account of land dispute. The counter case has also been filed by co-accused Anik Lal Rai who was brutally assaulted by Prem Lal Rai and others, for which,

Patna High Court Cr.Misc. No.51876 of 2017 (2) dt.08-11-2017 Ujiyarpur P.S. Case No. 193 of 2016 was filed against the informant and others.

Since prayer for anticipatory bail of the petitioner has earlier been rejected by this court, this court is not inclined to grant anticipatory bail to the petitioner. Therefore, prayer for anticipatory bail is again rejected.

The petitioner is directed to surrender in the court below within six weeks from the date of receipt of this order and seek regular bail which shall be disposed off in the court below on the same day in accordance with law without being prejudiced by this order, after taking into consideration, that anticipatory bail petition of other co-accused has been allowed by this court.
