The petitioner apprehends his arrest in connection with Tatarpur P.S. Case No. 3 of 2017, registered under Section 3/4 of the Explosive Substance Act.
The accusation is that on 03.01.2017, a bomb was exploded at the house of the informant, Saiyad Gulam Bandgi. When the informant came out from his house then saw that Md. Sheru and two others were fleeing away on motorcycle. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation one Sikardar was apprehended by the police in Kotwali P.S. Case No. 17 of 2017, who confessed his guilt about having hand in the
Patna High Court Cr.Misc. No.55128 of 2017 (2) dt.21-11-2017 present case with the association of the petitioner and one other except that nothing has been collected by the Investigating Officer against the petitioner. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Tatarpur P.S. Case No. 3 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
