JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner carries criminal antecedent and made his confessional statement before the police, but it appears that except criminal antecedent and confessional statement, there is nothing against the petitioner. So far as the probability of his absconding and tampering with the prosecution evidence is concerned, the same is only surmises and conjectures because the learned Sessions Judge has given the aforesaid findings without any material on the record.
Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
