2. The accused/petitioner seeks bail in connection with Sanhaula P.S. Case No.-59 of 2001, S.T. No. 400/2003 registered for the offences under Sections 304B/34 of the Indian Penal Code.

3. The accused/petitioner is named in the First Information Report and is in custody since 22.05.2025 on surrender.

4. Learned counsel appearing for the petitioner submitted that it is a case of first misuse of privilege of bail as granted by one of the learned coordinate Bench of this Court

Patna High Court CR. MISC. No.52003 of 2025(3) dt.15-11-2025 2/3 through Cr. Misc. No. 8602 of 2007 dated 23.03.2007. It is submitted that petitioner failed to appear in-person before the learned trial court on 02.05.2025 due to marriage ceremony in the family. It is submitted that petitioner never misused to attend the learned trial court since 2007 and out of first misuse to attend the court on 02.05.2025, he was taken into custody on 22.05.2025 and since, then, he is in custody.

5. Learned A.P.P. for the State is present.

Considering the aforesaid submission and by taking note of the fact as it is a case of first misuse, where petitioner failed to appear in-person before the learned trial court on 02.05.2025, and out of single and first misuse, he was taken into custody on 22.05.2025, therefore, being a first misuse, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Bhagalpur/concerned court, in connection with Sanhaula P.S. Case No.-59 of 2001, S.T. No. 400/2003, subject to the condition as laid down under Section 437(3) Cr.P.C/Section
