The petitioners apprehend arrest in connection with Sarairanjan P.S. Case No. 144 of 2017 registered for the offences under sections 307, 323, 325, 341, 379, 447, 504 and 506/34 of the Indian Penal Code.
The petitioners and informant are descendents of common ancestor. There appears bona fide land dispute between the parties and on the date of occurrence, altogether 7 FIR named accused persons allegedly abused and assaulted the informant and his family members. The allegation of firing and hurling bomb is against one Krishna Bhagwan Jha @ Tuna Jha who is not
Patna High Court Cr.Misc. No.50414 of 2017 (2) dt.30-10-2017 2/2 petitioner in this case. The allegation against petitioner no. 1 is that he caused injury by Farsa blow on the leg of the informant and allegation against petitioner no. 2 is that he assaulted by iron rod. The injury report on record shows that the injured sustained simple injury on their person. There is also a counter case from the side of these petitioners in which the family members of petitioners sustained injury.
Considering the facts and circumstances of the case, the prayer of anticipatory bail is allowed and the petitioners, namely, (1) Ghanshyam Jha, (2) Amit Kumar Jha @ Amit Jha and
(3) Nandlal Jha, in the event of arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Samastipur in connection with Sarairanjan Police Station Case No. 144 of 2017 subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
