Petitioner has moved this application renewing his prayer for bail. Earlier, his prayer was rejected on 20.11.2019 with an observation that if the trial is not concluded within one year, he may renew his prayer for bail (Annexure 1). The brief background is that the petitioner is alleged of killing his wife, i e., the daughter of the informant. The killing is for non-fulfillment of demand of dowry. This Court, on the earlier occasion, has taken note of the cause of death being shock and asphyxia as a result of smothering, which has been supported by the report of the Forensic Science Laboratory.

Additional Sessions Judge IV, Gaya has sent a report. It is stated in the report that three witnesses have been examined and summons to official witnesses have been issued.

Since, official witnesses only remain to be examined, this Court would reject the prayer for bail of the petitioner for the present with a liberty to renew his prayer after three months. The Superintendent of Police should take all suitable steps for ensuring appearance of the official witnesses. Petitioner should also cooperate for expeditious conclusion of the trial.
