This application is filed for Modification of order dated 02.08.2017 passed in Criminal Miscellaneous No. 19851 of 2017.

Learned counsel appearing on behalf of the petitioner submits that petitioner was granted Anticipatory Bail on 02.08.2017 passed in Criminal Miscellaneous No. 19851 of 2017 with a direction to surrender before the court below within a period of six weeks in connection with Bihta P.S. Case No.433 of 2016 pending in the Court of Addl. Chief Judicial Magistrate, Danapur, Patna, but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time.

No.54687 of 2017 (2) dt.13-12-2017 2/2 In such view of the matter, the time to surrender of petitioner as per order dated 02.08.2017 passed in Criminal Miscellaneous No. 19851 of 2017 is further extended by four weeks from today in connection with Bihta P.S. Case No.433 of 2016 pending in the Court of Addl. Chief Judicial Magistrate, Danapur, Patna.

Accordingly, the modification application is allowed and the order dated 02.08.2017 passed in Criminal Miscellaneous No. 19851 of 2017 is modified to the above extent. (Rajendra Kumar Mishra, J) manish/- U T
