JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 31-08-2018 Earlier this case was dismissed for non-prosecution on 12.09.2013. The writ petition was restored vide order dated 17.01.2017 in MJC No. 5592 of 2013. Thereafter the case was listed on different dates andno one had appeared on behalf of the petitioner. Under the aforesaid circumstances, the case has been listed today under the heading "For Dismissal" but unfortunately, no one has appeared on behalf of the petitioner even today. It is to be noted here that on 22.11.2017 submission was made on behalf of the petitioner that the similar issue is involved in SLP (Civil) No. 4025 of 2014, which is pending before the
Patna High Court CWJC No.17318 of 2013 dt.31-08-2018 2/2 Supreme Court and as such the case was directed to be listed after disposal of the said SLP. It appears that SLP (C ) No. 4025 of 2014 has been finally dismissed on 23.02.2018.
Since no one has been appearing on behalf of the petitioner for the last several dates and even today no one has appeared and in view of the fact that the SLP (C ) No. 4025 of 2014, on which the petitioner has placed reliance, as is evident from the order dated 22.11.2017, has been dismissed by the Apex Court, the present writ petition does not merit any consideration. In view of the dismissal of SLP © No. 4025 of 2014 (Upendra Singh Vs. The State of Bihar & Ors.), the present writ petition is dismissed.
