The petitioner has been in custody since 31.08.2014 in Araria P.S.Case No. 342 of 2014 registered for offences under sections 399, 402, 414 of the Indian Penal Code and 25 (1-b)a/26 (ii)/35 of the Arms Act.
Learned counsel for the petitioner submits that though the petitioner was not arrested at the place of occurrence and the name of the petitioner transpired on the basis of the confessional statement of co-accused.
Learned counsel for the petitioner further submits that such confessional statement made before the police, has no evidentiary value and since he is in custody.
Patna High Court Cr.Misc. No.9305 of 2015 (2) dt.10-04-2015 2/2 Considering the aforementioned submissions and also the fact that the petitioner is in custody since 31.08.2014, let the petitioner Md. Ilyas Yadav be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P. S. Case No. 342 of 2014.
