JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have assembled along with other co-accused to commit dacoity in a Bank but no firearm was recovered from conscious possession of the petitioner and only one loaded pistol was recovered from possession of another coaccused. Petitioner carries criminal antecedent of some cases but in the present case, he is languishing in jail custody since 7.01.2016 and it is improbable that a person would go to commit dacoity without having any firearm.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two

Patna High Court Cr.Misc. No.10354 of 2016 (2) dt.04-03-2016 2/2 sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra, Saran in connection with Bheldi P.S. Case No. 02 of 2016.
