JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 2708-2015 in a case registered under Section-364 of the Indian Penal Code.
No doubt, there is accusation that the petitioner and one co-accused, Mantu Kumar took the victim from his house and after that, the victim went missing and till today, he has not been recovered but taking note of this fact that having more or less similar allegation, co-accused Mantu Kumar has already been granted privilege of bail by a coordinate bench of this court and petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.11372 of 2016 (2) dt.14-03-2016 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patna Kotwali P.S. Case No. 492 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
