2. Learned counsel for the petitioner has submitted that the bail petitions of the petitioner have twice been rejected in Cr. Misc. Nos. 11842 of 2023 and 63465 of 2024, but while rejecting the bail application for the second time, it was observed by this Court that the learned court below shall take every endeavor to expedite the trial and dispose it of preferably within a period of nine months. He has submitted further that the stipulated period of nine months has elapsed but still the trial is pending. He has also submitted that the informant and other two witnesses, examined till date, have turned hostile.

3. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-II, Naugachiya in connection with Bihpur P.S. Case No. 358 of 2022, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
