1. Heard the parties.

2. Petitioner seeks regular bail in connection with S.T. No. 34 of 2024 arising out of Dhoraiya P.S. Case No. 51 of 2022, dated 06.02.2022, registered for the offence(s) punishable under Sections 302, 201, 120(B)of the Indian Penal Code.

3. Mr. Y.C. Verma, learned senior counsel for the petitioner submits that this is the second attempt of the petitioner to get the relief of regular bail and he has renewed his prayer mainly on the grounds of his long custody period as well as no progress in his trial. Learned counsel further submits that the petitioner has been languishing in jail since 09.02.2022 and he has been made accused due to village politics and he is completely innocent, having fair & clean antecedent and co-

Patna High Court CR. MISC. No.55059 of 2024(3) dt.13-09-2024 2/2 accused persons namely, Manoj Kumar Yadav and Manita Devi @Namita Devi have already been granted regular bail by this Court vide order dated 19.04.2024 passed in Cr. Misc. No. 10073 of 2024.

5. Mr. Shailendra Kumar, learned APP appearing for the State has opposed the bail prayer of the petitioner.

6. Heard both sides and perused the FIR and report sent by the trail court regarding the present status of the petitioner's trial which goes to show that the charges were framed upon the petitioners on 03.02.2024 and thereafter no prosecution witness has turned up till the date of sending of the report which shows lingering attitude of the prosecution.

7. Having regard to the above submissions, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with S.T. No. 34 of 2024 arising out of Dhoraiya P.S. Case No. 51 of 2022 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
