Informant, a salesman while returning after making collection over a vehicle was intercepted by the motorcycle ridden criminals who on the point of pistol snatched away mobile set, cash appertaining to Rs.2 lacs along with other material so detailed therein. From the order impugned it is evident that his name transpired during course of inculpatory extra judicial confessional statement of Md. Mukhtar. It is also apparent from the order impugned that on the confessional statement of petitioner Rs.9000/-, one motorcycle and a mobile has been recovered. It is also apparent that charge sheet had already been submitted however, neither mobile nor the cash so recovered has been put on T.I. Parade and in likewise manner petitioner has also not been put on T.I. Parade. Although, petitioner has got criminal antecedent but that is not going to change the scenario.
Patna High Court Cr.Misc. No.17237 of 2015 (2) dt.04-05-2015 Accordingly, petitioner Soukat is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with one surety to the satisfaction of learned Sub-divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No.373 of 2014 along with deposit Rs.10,000/-(Rupees Ten Thousand) in cash with an undertaking that henceforth petitioner will not indulge in any kind of criminal activity, failing which the amount so deposited will be forfeited.
