The petitioner is accused in connection with Khanpur P.S. Case No. 63 of 2015, registered under Sections 399, 402 and 120(B) of the Indian Penal Code. The accusation is that petitioner along with two others apprehended by the Police in suspicious condition, while 3 to 4 succeeded to flee away on two motorcycles. On search, one country made pistol and 22 cartridges were recovered from the possession of the petitioner.
Learned counsel for the petitioner submits that regarding recovery of the arms and ammunition, Khanpur P.S. Case No. 62 of 2015 was instituted by the Police in which
Patna High Court Cr.Misc. No.9044 of 2016 (2) dt.18-03-2016 2/2 petitioner has already been allowed bail vide Criminal Miscellaneous No. 53327 of 2015 passed on 26.11.2015. The petitioner is in custody since 22.12.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Samastipur in connection with Khanpur P.S. Case No. 63 of 2015 (S.T. No. 27 of 2016). Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
