JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 24-06-2015 Criminal Miscellaneous No.17819 of 2015 wherein Ramesh Rai is the petitioner and Criminal Miscellaneous No.21992 of 2015 wherein Ram Bharosha Rai is the petitioner commonly originate out of Chakai P. S. Case no.152 of 2011, on account thereof, have been heard together and are being disposed of by a common order.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

Patna High Court Cr.Misc. No.17819 of 2015 (03) dt.24-06-2015 Husband of informant namely Basudeo Rajak took away calf for grazing and since thereafter, did not return. On the following day his dead body was found inundated having injuries over his person. It has also been alleged that one person belonging to Antu Rai's family had approached the informant and further, complained regarding grazing of the crop by the calf and on account thereof, had instructed to son of Basudeo for negotiation. Accordingly, informant apprehended active hands of family members of Antu Rai in commission of murder of her husband. Perused the case diary. None is an eye witness to occurrence. Suspicion has been cast in the background of complain having made by one of the family members of Antu Rai.

Accordingly, petitioners, Ramesh Rai and Ram Bharosha Rai each are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Chakai P. S. Case no.152 of 2011.
