The petitioner being the husband of the informant is languishing in custody since 15.12.2015 in a case registered for the offences punishable under sections 323, 341, 498A, 504/34 of the Indian Penal Code.
Basic accusation is of torture.
Learned counsel for the petitioner submits that the petitioner admits his marriage with the informant and the informant at earlier point of time filed Pupri P.S. Case No.182/2013 levelling accusation under sections 363 and 365 of the Indian Penal Code against the other family members of the petitioner alleging that the petitioner was kidnapped by his other family members. It is further submitted that the in the
Patna High Court Cr.Misc. No.8819 of 2016 (2) dt.24-02-2016 2/2 background of the above fact reconciliation is not feasible at present. But the petitioner is ready to make payment of permanent alimony to the informant on dissolution of marriage. Though, statement to that effect has not been in the petition. On instruction, learned counsel for informant submits that the informant accepts the offer of the petitioner. Considering the present stand of the parties, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sadar, Sitamarhi in connection with Sitamarhi P.S. Case No.384/2012. It is expected from the learned court below to make effort to resolve the issue between the parties, in accordance with law, in view of the present stand of the parties.
