The petitioner seeks bail in connection with Rajiv Nagar P.S. Case No.385 of 2015 registered under Sections 147, 148, 149, 387, 341, 323, 324, 504, 506, 307, 302, 448 and 120(B) of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that on the basis of the Fardbeyan of the informant, Kishlay Singh alias Yaddu Singh, the present case bearing Rajiv Nagar P.S. Case No.385 of 2015 was instituted against 12 named and 30-40 unknown accused and the name of the petitioner does not find mention in the Fardbeyan of the informant. Later on, in

No.9425 of 2016 (3) dt.25-04-2016 2/2 course of investigation, one witness, namely, Mantu Kumar, in his statement, as detailed in paragraph-10 of the case diary, has disclosed the name of the petitioner being a member of the mob without attributing any specific overt act against him. The petitioner is in custody since 19.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Niraj Kumar Tyagi, Judicial Magistrate, First Class, Patna, in connection with Rajiv Nagar P.S. Case No.385 of 2015.
