The petitioner apprehends his arrest in connection with Murliganj P.S. Case no. 237 of 2017, registered under Sections 341, 323, 379, 384, 386 and 506/34 of the Indian Penal Code. The accusation is that the informant was engaged in filling soil in his plot in the morning of 27.07.2017. At that time, five persons named in the F.I.R, including the petitioner came there and forbade the informant to fill up the soil in the field and made demand of ransom of Rs. One lakh. When the informant made protest then Jai Krishna Yadav folded the neck of the informant with the help of Gamchha and started to push his neck and Subodh Kumar pointed three nut pistol at his chest saying that if he will not give money he will be shot fire. Thereafter, informant anyhow succeeded to flee from
Patna High Court Cr.Misc. No.60947 of 2017 (2) dt.19-12-2017 2/2 there. At that time, Dinesh Yadav snatched wrist watch and golden chain of the informant.
Learned counsel for the petitioner submits that, in fact, petitioner and informant are resident of same village and he has falsely been implicated in this case without any overt act due to dirty village politics. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 237 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
