1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 63 of 2024 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, three unknown persons looted Rs. 50,000/- from the informant at gun point. They have also fired which hit one of the co-accused who died.

4. The petitioner is the assailant of the deceased, Kundan Kumar. He has participated in the loot also. One country made pistol has been recovered from the petitioner and looted bag has been recovered from the house of the co-accused, Nitik Kumar on the information given by Kundan Kumar, the

Patna High Court CR. MISC. No.57568 of 2024(3) dt.25-09-2024 2/2 petitioner. The petitioner is in custody since 14.03.2024.

5. Considering the aforesaid facts, I am not inclined to grant bail to the petitioner.
