JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-06-2015 Heard counsel for the petitioner and the State. The petitioner is accused in Jakkanpur P.S. Case No. 513 of 2014 registered under section 414 and 120-B/34 IPC and is languishing in jail since 01.01.2015. Two motor cycles of which the petitioner was one of the occupants are said to have been checked by the informant and found stolen ones. Accordingly the case lodged against the petitioner and several others. Contention of the petitioner is that he has no criminal antecedent and is languishing in jail since 01.01.2015. Referring to Annexure-2, it has been submitted that other co accuseds named in the FIR having similar/identical allegations have been released on bail by this Court. Relying on the order dated 25.03.2015 passed in B.P. No. 518/2015 as well as the order

Patna High Court Cr.Misc. No.16820 of 2015 (3) dt.25-06-2015 2 / 2 dated 09.04.2015 passed in B.P. No. 706/2015 it has been stated that other co accused namely Udai Kumar and Ravi Shanker @ Goldi have also been released on bail by the Sessions Judge. Considering the aforesaid as also the fact that the petitioner above named has no criminal antecedent he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Praveen Kumar Singh, J.M. 1st Class Patna in Jakkanpur P.S. Case No. 513/14 (G.R. 25/15) on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge he shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, his bail bonds shall stand cancelled. During the subsistency of this privilege if the petitioner is found involved in any other case of similar nature the same shall entail cancellation of his bail bonds.
