2. Learned counsel for the petitioner submits that the petitioner's prayer for bail was earlier rejected vide order dated 01.10.2024 passed in Criminal Miscellaneous No. 68847/2024, with liberty granted to renew the prayer for bail nine months after framing of charge, if trial Court shall not conclude the trial within the said period. Learned counsel further submits that the petitioner is in custody since. 24.02.2024 and charge has been framed on 16.08.2024. The antecedents of the petitioner are clean.

3. Learned APP for the State opposes the prayer for bail and submits that though 10 kg ganja has been recovered

Patna High Court CR. MISC. No.46162 of 2025(3) dt.12-09-2025 2/2 from the bag of the petitioner, but the said contraband is less than the commercial quantity. Learned counsel further submits that on the earlier occasion, a report regarding the present stage of the trial and the expected time frame for its conclusion was called for.

4. Upon perusal of the report, it appears that the Sessions Trial is presently at the stage of prosecution evidence. Out of seven prosecution witnesses, three have already been examined.

5. In view of the aforesaid circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail in connection with NDPS Case No. 71/2024 (Rail P.S. Case No. 29/2024), pending before the Court of the learned Exclusive Special Court-1(NDPS), Muzaffarpur, is hereby rejected.
