This application for grant of regular bail arises out of Trial No. 4322 of 2020 arising out of Excise Case No. 43 of 2020, disclosing offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The petitioner is in custody since 08.02.2020. He was apprehended while driving the vehicle from which 1259 liters of illicit foreign liquor was recovered. He had earlier approached this Court for grant of regular bail, which was rejected by order dated 20.08.2020 passed in Cr. Misc. No. 20976 of 2020. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Second Additional District and Sessions Judge-cum-Special Judge, Gopalganj in Trial No. 4344 of 2020 arising out of Excise Case No. 43 of 2020, subject to the condition that if the petitioner will indulge in such activities in near future, the State shall be at liberty to pray for cancellation of his bail.
