The petitioner is accused in connection with Sessions Trial No. 772 of 2013 arising out of Lakhisarai (Kabaiya) P.S. Case No. 351 of 2011 registered under Sections 304(B)/201/34 of the Indian Penal Code.

Earlier prayer of the petitioner for bail was rejected on merit twice by this Court vide Cr. Misc. No. 24583 of 2013 on 29.01.2014 and Cr. Misc. No.39535 of 2014 on 15.10.2014. The report, as called for from the 5th Additional District and Sessions Judge, Lakhisarai, discloses that out of 21 witnesses, only two witnesses have been examined and the expected time for disposal of the case is about one year.

No.17255 of 2015 (3) dt.24-06-2015 2/2 petitioner submits that in fact, the wife of the petitioner committed suicide due to family quarrel and informant also participated in the last ceremony, but later on, informant, father of the deceased, lodged the false case with ulterior motive. It is also submitted that petitioner is in custody since 05.01.2013, having no criminal antecedent.

Having considered the facts and circumstances of the case and also the period of custody of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional District and Sections Judge, Lakhisarai in connection with Sessions Trial Case No. 772 of 2013 arising out of Lakhisarai (Kabaiya) P.S.
