JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 08-08-2025 At the outset, learned counsel for the petitioner seeks and is granted permission to make necessary correction in paragraph no. 1 and paragraph no. 4 of the bail petition.

2. The petitioner is in custody in connection with Bibhutipur P.S Case No. 150 of 2025 registered for the offences punishable under Sections 25(1-B)a, 26, 35 Arms Act

3. As per allegation in the FIR, petitioner was exhibiting country made pistol on social media platform, thereafter, he was identified and searched in which one country made pistol and cartridge has been recovered from the house of one Raushan Kumar.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the alleged recovered was made from the house of Raushan Kumar and not from the house of the petitioner. He

Patna High Court CR. MISC. No.47689 of 2025(2) dt.08-08-2025 2/2 further submits that the only allegation upon the petitioner is that he was seen exhibiting pistol in the viral video. It is also submitted that petitioner is in judicial custody since 21.04.2025 having clean antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR and 12.06.2025, it appears that nothing has been recovered from the possession of the petitioner rather country made pistol and cartridge has been recovered from the possession of the co-accused namely Raushan Kumar. Only allegation against the petitioner is that he was seen in the viral video with the country made pistol. Considering the materials available on record and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Rosera in connection with Bibhutipur P.S.
