Patna High Court Cr.Misc. No.46162 of 2014 (4) dt.13-04-2015 2/3 CORAM: HONOURABLE MR. JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-04-2015 Heard the learned counsel for the petitioners, the State and the informant.

All the applications arise out of Begusarai Town P.S. Case No.169 of 2014 for the offence punishable under Sections 363, 364 and 364A of the Indian Penal Code and the charge sheet has been submitted for the offence punishable under Sections 364A, 302, 201, 120B of the Indian Penal Code, as such, they have been heard together and are being disposed of by this common order.

It is submitted that the FIR was lodged against unknown for kidnapping a student of class III. During investigation, name of the petitioners and others has appeared in the confessional statement of co-accused Rahul Kumar. After investigation, charge-sheet has already been submitted. Considering the submissions that the name of the petitioners has appeared in the confessional statement of the coaccused Rahul Kumar and in similar facts and circumstances, the co-accused Chandan Kumar and Kirpa Shankar Kumar have been granted bail vide Cr. Misc. Nos.7783/2015 and 45693/2014, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount

Patna High Court Cr.Misc. No.46162 of 2014 (4) dt.13-04-2015 3/3 each to the satisfaction of learned Additional Sessions Judge-VIII, Begusarai in Sessions Trial No.578 of 2014 arising out of Begusarai Town P.S. Case No.169 of 2014 after framing of charge with the following conditions :

1.

One of the bailors will be the close relative of the petitioners.

2.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
