The petitioner seeks bail in POCSO, G.R. No. 07 of 2020, arising out of Mahila P.S. Case No. 15 of 2020 registered for the offence under Section 376 DB of the Indian Penal Code and Sections 4/6 of POCSO Act.

As per the prosecution case, this petitioner alongwith two other persons committed gang rape with the minor daughter of the informant.

It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. It is further submitted that trial has already commenced and it has been proceeding smoothly and uptilnow, three witnesses have already been examined.

Considering the nature of allegation and gravity of the

Patna High Court CR. MISC. No.1972 of 2021(3) dt.20-05-2021 2/2 offence, the bail application of petitioner is rejected. However, the learned trial court is directed to conclude the trial as early as possible.
