====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 22-03-2023 Heard Mr. Rajesh Kumar, learned counsel appearing on behalf of the petitioner and Mr. Ajay Kumar, learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 17 of 2021, registered under Sections 498(A), 406 and 313/34 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner informs this Court that he has stated in paragraph No. 8 of the bail application that O.P. No.2 has already solemnized marriage with one Prem Sahani without getting divorce from the petitioner. The petitioner is ready to keep his wife with full dignity and honour.

4. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.
5. Having heard both the sides and the material available on the record as well as considering the facts and circumstances of the case, the petitioner is ready to live with the O.P. No.2 and to that effect he has also made statement in paragraph No.7 of the bail application, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran Motihari in connection with Mahila P.S. Case No. 17 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
