Petitioner seeks bail in a case registered for the offence punishable under Section 304(B) and 34 of the Indian Penal Code.

Informant is the father of the deceased, who has alleged in his FIR that marriage of her daughter with son of petitioner was solemnized and thereafter she was tortured due to demand of dowry and thereafter she was killed.

It has been submitted on behalf of the petitioner that she is innocent and has falsely been implicated in this case. It has been further submitted that during the trial, informant and other prosecution witnesses have not supported the case of prosecution and the deceased committed suicide and it was a suicidal death and not homicidal. Petitioner is mother-in-law

Patna High Court CR. MISC. No.57434 of 2021(2) dt.30-03-2022 2/2 and there is general and omnibus allegations against her. Husband of the deceased is in custody. Petitioner is in custody since 01.07.2020.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Mansurchak P.S. Case No. 29/2020 with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
