JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On trivial issue, it has been alleged against the petitioner to have inflicted Farsa blow over head of Poonam Devi while Suraj Yadav had inflicted Farsa blow over informant, Premwati Devi. It has also been alleged that Suraj had snatched away Mangalsutra. Ram Dai Devi, Meera Devi, Hira Devi, Rakesh Yadav and others have also assaulted lathi and danda blow.

From the order impugned, it is evident that Poonam Devi had sustained simple injury 3"x 1⁄2" x 1⁄2". No repetition of blow has been perceived. Petitioner happens to be under custody since 28.02.2015.

That being so, petitioner Sant Yadav @ Sant

Patna High Court Cr.Misc. No.17176 of 2015 (02) dt.01-05-2015 Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P. S. Case no.113 of 2014.
