Petitioner was posted as BDO at the relevant time and accusation against him is that he issued advisory on the list prepared by the Mukhiya and Panchayat Secretary regarding beneficiaries of Indira Awas scheme but subsequently, it was found that bogus list had been prepared and on the basis of bogus list, huge government money was withdrawn.

Involvement of the petitioner came in light in course of investigation only to this extent that he issued advisory in respect of prepared list of beneficiaries.

Moreover, the concerned Mukhiya and Panchyat Secretary have already been granted privilege of anticipatory bail by this court. Considering the aforesaid facts and circumstances as well as

No.8508 of 2016 (2) dt.26-02-2016 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Tarabari P.S. Case no. 45/2012.
