JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report on the accusation that they kidnapped the victim and assaulted him and, subsequently, police got released the victim from the clutches of the petitioners. The statement of victim was recorded under section 164 of the Cr.P.C in which he supported the prosecution story.
Submission on behalf of the petitioners is that, as a matter of fact, the wife of petitioner no. 1 had some sweet relation with the informant of the present case and she disappeared and in search of her, the petitioners and other accused went at the house of the informant and while they were making inquiry from the victim in respect of whereabouts of wife of petitioner no. 1, the
Patna High Court Cr.Misc. No.8590 of 2016 (2) dt.29-02-2016 2/2 informant called the police and got arrested the petitioners along with victim. Moreover, when the informant and his supporters realized their fault, they entered into compromise and settled the dispute amicably.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with K.Hat ( Maranga) P.S.Case No. 724 of 2015.
