The petitioner is languishing in custody for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 20/22 of the N.D.P.S. Act.

Submission is that nothing was recovered from the possession of the petitioner; rather recovery of 97 grams of Ganja and recovery of liquor is from the possession of coaccused Gautam Raj, who has already been allowed bail by a coordinate Bench of this Court vide Annexure-2. The petitioner is in custody since 09.04.2019. Investigation of the case is already complete.

No.45068 of 2019(2) dt.23-07-2019 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Srikrishnapuri P.S. Case No.122 of 2019, Special Case No.3722 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
