JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 31-07-2015 Since the State has chosen not to file any counter affidavit ever since filing of the writ application on 14.01.2009 and despite a direction issued even on 2.7.2015, the Court is left with no option but to allow the writ application and direct the respondents not to disturb the petitioner by encroaching over the land i.e. Old Plot No.464, situate in Village - Naripa, Thana No. 407, Anchal - Rajoun, in the district of Banka. If there are any fall outs upon the administration because of the present order, the responsibility lies upon the District Magistrate, Banka and the Anchal Adhikari.
Writ application is allowed.
