JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused of Sarsi P.S. Case No. 08 of 2015 registered under sections 363, 372, 370 & 120-B/34 IPC. The husband of the victim has alleged that while he was away from home the petitioner kidnapped his wife along with her two children. Along with his wife one Rambha Kumai was also kidnapped. Subsequently, she escaped from the captivity and narrated that she along with the wife and children of the informant were kidnapped by the petitioner.
Learned counsel for the petitioner draws attention of the Court to the statement of the victim made under section 164 Cr. P.C. (Annexure-2) wherein she has not alleged any such kidnapping at the hands of the petitioner. According to her statement the victim was arrested by the police while in
Patna High Court Cr.Misc. No.19288 of 2015 (3) dt.02-07-2015 2/2 company of the petitioner who is her co villager. It is stated that there is no criminal antecedent against the petitioner. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction Sri Lal Bahadur Prasad, learned Judicial Magistrate , 2nd Class, Purnea in Sarsi P.S. Case No. 08 of 2015 on condition that one of the bailors shall be own/close family member of the petitioner. As soon as the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds.
