2. The petitioner seeks regular bail in connection with Barahara (Krishnagarh) Police Station Case No. 391 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per prosecution, about 50 litres of foreign liquor has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 26.06.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court 1st, Bhojpur, Ara in connection with Barahara (Krishnagarh) Police Station Case No. 391 of 2023.
