JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Taraiya P.S. Case No. 175 of 2016, disclosing offences under Sections 147, 149, 341, 323, 379, 504, 427, 354, 153(A) & 295 of IPC and Section 10/13 of Unlawful Activitiy Act.

Allegation against the petitioners and other accused persons that they assaulted the informant by lathi and danda, causing injury and they have passed in front of the house of informant and raising slogan and rampaged the Mosque and abuse the informant. Further allegation is that when the relatives

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them and the other accused persons, having similar allegation, have been granted bail by a Co-ordinate Bench of this Court as well as by this Court, vide order dated 15.01.2019 passed in Criminal Misc. No. 1900 of 2019 and vide order dated 02.04.2019 passed in Criminal Misc. No. 17205 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M. IX, Saran at Chapra, in connection with Taraiya P.S. Case No. 175 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
