JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This application, for grant of anticipatory bail, arises out of Alinagar P.S. Case No. 126/18, disclosing offences under Sections 147, 148, 149, 188, 228, 353, 337, 338, 504 and 427 of the Indian Penal Code.

Allegation as per F.I.R. is that about two hundred people assembled in a protest of murder and they attacked and brick batted the police party and petitioners are also named in the F.I.R.

Submission of learned counsel for the petitioners that they have no criminal antecedents and have falsely been implicated in this case and although they are named in the F.I.R.

Patna High Court CR. MISC. No.44962 of 2019(2) dt.22-07-2019 2/2 but no specific allegation has been attributed to them. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Benpur, Darbhanga, in connection with Alinagar P.S. Case No. 126/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
