JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-07-2024 At the outset, the learned counsel for the parties have pointed out that one Jamabandi Correction Appeal No.24 of 2012 had been filed by the petitioner, however, the same was disposed off, by an order dated 10.10.2017, passed by the Collector, Khagaria, whereafter the petitioner had preferred a Zamabandi Correction Revision Case No.99 of 2017, before the Divisional Commissioner, Muger, who, by an order dated 13.12.2022, has remanded the matter back to the Collector, Khagaria for passing a fresh order.

In view of the aforesaid, the learned counsel for the petitioner submits that aforesaid Zamabandi Correction Appeal No.24 of 2012, which has now stood reopened/revived, be directed to be disposed off, within a stipulated time frame and during the interregnum period some protection be granted to the petitioner.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Collector, Khagaria to dispose off the aforesaid Zamabandi Correction Appeal No.24 of 2012, in case the same is still pending, by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks of receipt/production of a copy of this order, and till then, no coercive action shall be taken against the petitioner.

4. The writ petition stands disposed off on the aforesaid terms.
