The petitioner is accused in connection with Harnaut P.S. Case No. 415 of 2015, registered under Section 379, 411, 413 and 414 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that Kartik Giri and Ravi Shankar Prasad were apprehended by the Police with stolen motorcycle, who disclosed the name of petitioner and one Rahul Kumar Singh with allegation that both are their associates and Police indulged him in committing the theft of the motorcycle. The Police seized the motorcycle in front of the house of the petitioner. The petitioner having no criminal
Patna High Court Cr.Misc. No.9336 of 2016 (2) dt.06-04-2016 2/2 antecedent is in custody since 24.11.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-V, Biharsharif, Nalanda in connection with Harnaut P.S. Case No. 415 of 2015 (G.R. No. 4571 of 2015). Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
